Terms and conditions

By registering to participate in the British Vogue X Hewi The Way We Wore sale (the Sale), you expressly agree to these terms and conditions.

References in this document to "hardlyeverwornit.com", "we" or "us" mean We are Hardly Ever Ltd, a company registered in the United Kingdom under company number 7002732 and with our registered office and main trading address at 11 Manchester Square, London, W1U 3PW. Our VAT number is 124 9705 10. References herein to "you" and "your" mean the person or entity registering to bid or bidding in the Sale.

  1. Registration
    1. Before you can bid, you must register to bid. The registration page can be accessed by clicking here.
    2. Once you have registered you should keep your account details strictly confidential and you must not permit any third party to use or access your account on your behalf or otherwise. You will be liable for any and all bids made via your account.
    3. In order to register you must be at least 18 years old and you must have the capacity to enter into a legally binding contract in accordance with applicable laws.
    4. You shall ensure that the information provided in your registration to bid is complete, accurate and truthful.
  1. Bidding Process
    1. Once you have successfully registered, you will be eligible to bid at the Sale.
    2. During the Sale, you can bid for a lot by selecting the Place Bid or Place Maximum Bid button. Each bid shall be final and binding as soon as you select the Place Bid or Place Maximum Bid button.
    3. The current bid will be displayed on your screen during the Sale. In the event of a tie between a bid placed by you and any other identical bid(s), the bid which was placed first will be accepted.
    4. You acknowledge that you are bidding in a live auction and you agree that each bid submitted as provided in these terms and conditions is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted via your account (including the liability to pay in full and on time for any lot that is the subject of a successful bid submitted from your account).
    5. All bid prices and the prices of prints are inclusive of sales tax.
    6. Please be aware that any import charges/duties are the buyer's responsibility to pay. All buyers must check if they are liable for import charges before purchase. Neither Hardly Ever Ltd. nor Vogue will be liable for payment of any import duties or taxes on any lot. The displayed current bid amounts and winning bid amounts do not include import duties or taxes.
    7. Bids do not include shipping costs, these will be calculated based on the winning bidder’s location and added to the final bid price of each lot once the Sale has been completed.
    8. Please note that we reserve the right to reject a registration to bid, withdraw its permission for you to bid, or terminate an account, for any reason at any time prior to, during or after the Sale.
  1. After the Sale
    1. If you have been successful in your bidding, you will receive an email from us.
    2. You agree to pay for any lot that is the subject of a successful bid submitted by you or from your account.
    3. A member of the Hardly Ever Worn it team will contact you to arrange payment over the phone. Please note that if it is not possible to contact you or if payment is not made within a timely window, we reserve the right to contact the next highest bidder at our discretion.
    4. Payments are accepted via bank transfer, VISA, AMEX, Mastercard debit and credit cards or PayPal.
    5. If you wish to make payment by bank transfer, please ensure to select to pay yourself all bank charges on the payment. Lots will not be shipped until the full winning bid and shipping cost amounts have been received.
    6. All sales are final and returns will not be accepted. Please carefully read each lot’s condition report, sizing information and measurements before bidding.
  1. Bidding and Limitations Of hardlyeverywornit.com’s Liability
    1. If you choose to bid, you do so entirely at your own risk. Access to the Sale and bidding is dependent upon, among other things, the availability of the internet and the speed and quality of internet connections.
    2. You are advised to conduct your own research into the applicable exchange rates prior to placing a bid. Please note that the Sale is conducted, and all bids must be made, in British Pound Sterling (GBP). All bidding increments will be in GBP only. Payment for any lot that is the subject of a successful bid must also be made in GBP and not in any other currency.
    3. The content displayed on the Site may contain inaccuracies and typographical errors and we do not warrant the accuracy or completeness of the content or that any defects will be corrected. Any reliance on any such content, advice, statement, or other information shall be at your sole risk. We reserve the right, in our sole discretion, to correct any errors or omissions in any portion of the Site and to make any changes to the features, functionality or content of the Site at any time.
    4. Lots are not available for inspection prior to the Sale. You are strongly advised to closely examine all photographs and read carefully the condition and sizing descriptions for each lot that you may bid on.
    5. Access to the Site is made available as a convenience and on a temporary basis, and we reserve the right to suspend or terminate any aspect or feature of the Site at any time, with or without notice. Without limiting the foregoing, we may suspend access to the Site to carry out scheduled or unscheduled maintenance or for any other reason at any time.
    6. WE ACCEPT NO LIABILITY FOR ANY FAILURE OR DELAY IN EXECUTING BIDS OR ANY ERRORS CONTAINED IN BIDS PLACED THE SITE.
    7. Hardly Ever Ltd AND ITS SUPPLIERS PROVIDE THE SITE "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WITHOUT LIMITING THE FOREGOING, WE ACCEPT NO LIABILITY FOR ANY FAILURES, DELAYS OR ERRORS CAUSED BY INTERRUPTIONS IN THE AVAILABILITY OF THE SITE OR ANY ERRORS OR DEFECTS IN ITS CONTENT OR FUNCTIONALITY, ANY SOFTWARE AND/OR HARDWARE DEFECTS (WHETHER YOURS OR OURS) AND/OR ANY INTERNET CONNECTION PROBLEMS (WHETHER YOURS OR OURS), AND WE DO NOT REPRESENT OR WARRANT THAT THE SITE WILL BE ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
  1. Events Outside Our Control
    1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below.
    2. An "Event Outside Our Control" means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, snow, flood, earthquake, subsidence, pandemic or other natural disaster, failure of public or private telecommunications networks, impossibility of the use of motor transport or other means of public or private transport, road traffic accidents, road closures or mechanical failure.
  1. Other Important Terms
    1. All of the images displayed on the auction website, including but not limited to images of lots, company/charity logos and images of models, are the property of Hardly Ever Ltd and British Vogue and may not be used by any third party without explicit written consent.
    2. These Terms are only available in the English language.
  1. Changes to These Terms and Conditions
    We may from time to time make changes to these terms and conditions. Please review these terms and conditions regularly to ensure you are aware of any changes made by us. If you use the Site after changes have been made, you shall be deemed to have agreed to such changes. If you do not agree to such changes, you should not make any subsequent use of the Site.
